Complaints process overview

This page explains how School District 10 (Arrow Lakes) expects parents, students, and community members to raise concerns or pursue formal appeals. The district provides a complaint pathway through Policy 220 – Inquiries & Concerns and supporting procedures, followed by a formal appeal process governed by Bylaw No. 4 under section 11 of the School Act.


How the district frames complaints

SD10 frames complaints as a process of respectful communication and collaborative problem-solving.

The district emphasises:

  • open and respectful communication
  • addressing concerns promptly
  • resolving issues at the earliest possible stage
  • maintaining confidentiality and professionalism

Parents and students are expected to work through the inquiry and concern process before pursuing a formal appeal.


Inquiries and concerns (informal process)

The district provides a structured but informal escalation pathway.

Step 1: Speak with the person involved

Concerns should first be raised directly with the staff member involved.
Both parties may bring an advocate and attempt to resolve the issue through discussion.

Step 2: Escalate to the principal or supervisor

If the concern is not resolved, it may be brought to the school principal or appropriate supervisor.
The administrator reviews the issue, communicates with all parties, and attempts to resolve the concern.

Step 3: Escalate to district administration

If the issue remains unresolved, a written statement may be submitted to the Assistant Superintendent.
The district will:

  • review the information
  • contact the parties involved
  • attempt resolution
  • provide a written response outlining actions to be taken

The district encourages giving each step an opportunity to resolve the issue before moving to the next.


Formal appeal process (Bylaw No. 4)

If the concern is not resolved through the inquiry process, a parent or student may appeal a decision of a board employee that significantly affects the education, health, or safety of a student.


What can be appealed

Appeals are limited to decisions that significantly affect a student’s education, health, or safety.

Examples include:

  • suspensions longer than 10 consecutive days
  • suspensions for health reasons
  • placement in an educational program
  • promotion or graduation decisions
  • refusal to offer an educational program to an eligible student

Importantly:

👉 Failure to make a decision is treated as a decision for the purpose of appeal.


Filing an appeal

To begin an appeal:

  • A written Notice of Appeal must be submitted to the Board
  • The notice must normally be filed within 30 days of the decision

The Notice of Appeal must include:

  • student and parent/guardian information
  • current school placement
  • the decision being appealed and date communicated
  • the employee responsible
  • the grounds for appeal and the remedy sought

Required prior steps

Before the Board will hear an appeal:

  • The parent or student must first discuss the issue with the employee who made the decision
  • The Board may refuse to hear the appeal if this step has not been completed

The Superintendent or Board may also direct further discussions before proceeding.


Board review and hearing

Once an appeal is accepted:

  • The Superintendent or designate prepares a report for the Board
  • The Board may request written submissions or hold an oral hearing
  • The student or parent may bring an advocate
  • The Board may investigate further if needed

Decision

The Board:

  • deliberates
  • may issue interim decisions if needed
  • provides a written decision to the parties

The decision is communicated promptly following deliberation.


Grounds for refusal

The Board may refuse to hear an appeal if:

  • it is filed more than 30 days after the decision
  • required prior discussion steps were not completed
  • the matter does not significantly affect the student’s education, health, or safety

Provincial appeal

If the Board’s decision does not resolve the matter, the decision may be appealed to the Superintendent of Achievement under the School Act.


Complete escalation pathway

Step 1: Discuss concern with the staff member involved
Step 2: Escalate to the principal or supervisor
Step 3: Submit written concern to district administration (Assistant Superintendent)
Step 4: Submit written Notice of Appeal to the Board
Step 5: Board review, possible hearing, and decision
Step 6: Provincial appeal to the Superintendent of Achievement


Guiding principles

  • Concerns should be addressed as close to the source as possible
  • Respectful communication is expected throughout
  • Each step should be given an opportunity to resolve the issue
  • Appeals are limited to significant impacts on a student
  • Failure to respond may be treated as a decision in the appeal context
